Kulturmanager/-innen erfahren heute den Anspruch, eine professionelle Haltung und ein professionelles Ansehen (‚standing‘) zu gewinnen, als eine Selbstverständlichkeit ihres Berufsbilds. Bei diesem Stand der Dinge verspricht der Versuch, Kulturmanagement in einem professionalisierungstheoretischen Rahmen zu beschreiben, interessante Aufschlüsse über die Natur von Kulturmanagement. Und unter dieser Prämisse stehen die folgenden Überlegungen. Sie liefern Gründe für eine affirmative Antwort auf die Ausgangsfrage: Kulturmanagement benötigt eine genuin kulturwissenschaftliche (im Unterschied z. B. zu einer ethologischen oder philosophischen) Kulturtheorie (Abschnitt 2) und zudem eine normativ gehaltvolle, nicht bloß deskriptive organisationssoziologische Professionalisierungstheorie.
Culture management is primarily a practical affair that needs appropriate management skills and competencies. It is argued that culture management moreover needs a properly reflexive theory of cultural processes, and more specifically, cultural processes in the various domains of the arts. Such a theory must go far beyond what usually passes as "management theory" since it has to deal with the complex logic of cultural objects, activities, practices, persons, incentives and constraints. In particular, culture managers would benefit (it is argued) from the social theory of the professions and of professionalisation. Cultural managers can strife for genuine professionalisation, on the model of other genuine professionals like doctors or lawyers, if they understand the basic challenge in their job as trying to help to sustain the intrinsic rationality of the primary cultural practice that they care for as managers vis-a-vis other determinate rationalities embodied in other social systems, fields, and actors, e.g. economic and political rationalities. The core normative purpose of culture management, on this view, is the reconciliation of various rationalities that compete but whose joint synergies are needed in order to promote as much and as good as possible the rationality of the particular cultural practice (e.g., an opera house, a theater, a cinema) for which the cultural manager has been trusted with a mandate.

Rechtspolitischer Sinn oder Unsinn von Kulturförderungsgesetzen

Der Beitrag thematisiert die Art der rechtlichen Ausgestaltung der öffentlichen Kulturförderung in den deutschsprachigen Ländern, nämlich durch Kulturförderungsgesetze (in Österreich und in der Schweiz) oder durch rechtsförmliche Satzungen und Richtlinien (vorwiegender Usus in Deutschland). Die Diskussion entfaltet sich entlang zwei Grundfragen: a) Wie können die Ziele der Kulturförderungspolitik effektiver umgesetzt werden bzw. kann eine umfassende Richtlinie dasselbe leisten wie ein Gesetz? b) Welche rechtspolitischen Überlegungen und Absichten werden verfolgt, wenn der Staat einen Bereich wie die Kulturförderung per Gesetz oder mittels Erlassen regelt?
Gesetze implizieren einen Gesetzesauftrag. Das bedeutet eine stärkere Verankerung der öffentlichen Kulturförderung im Gesamtgefüge des Staates oder der einzelnen Länder bzw. Kantonen. Allerdings ist die Kritik einer Verrechtlichung solange relevant, bis es nachweisbar ist, dass Kulturförderungsgesetze einen politischen und administrativen Mehrwert erbringen. Vier Anforderungen werden hierbei genannt. Einschlägige Gesetze müssen: 1) elementare Kriterien von „Good Governance“ erfüllen, 2) die Machtasymmetrie zwischen Kulturbehörden und den AdressatInnen durch neue Formen von „Cultural Governance“ verringern, 3) die Verfahrensstandards stärken und 4) ein Monitoring für die Allokationspolitik vorsehen.
The article addresses the kind of legal form of public promotion and funding of culture in the German-speaking countries, namely through laws on the promotion of culture (in Austria and Switzerland) or through legal clauses and guidelines (primarily the practice in Germany). The discussion develops on the basis of two basic questions: a) How can the objectives of culture-promotion policy be more effectively implemented or can a comprehensive guideline achieve the same as a law? b) What legal-policy considerations and intentions are being pursued when the state regulates a field such as the promotion of culture through laws or by means of decrees?
Laws imply a statutory mandate. This means a stronger anchoring of public promotion of culture in the whole structure of the state or the individual provinces or cantons. However, the criticism of juridification is relevant unless it is demonstrable that laws for the promotion of culture contribute an added political and administrative value. Four requirements are mentioned here. Pertinent laws must: 1) fulfil the elementary criteria of “good governance”, 2) reduce the asymmetry of power between the cultural authorities and the recipients through new forms of cultural governance, 3) strengthen procedural standards, and 4) envisage monitoring of the allocation policy.
